A green card for the parents of a US citizen

If you are a US citizen aged 21 or older, you can petition for your mother and father. There is no queue for parents of citizens.

How a green card for parents works

Parents of a US citizen are immediate relatives, so there is no Visa Bulletin queue for them. A citizen aged 21 or older files Form I-130 — separately for each parent. The parent then obtains a green card inside the US (I-485, if they entered lawfully) or through NVC and a consulate in their country of residence. A green card holder cannot sponsor parents — naturalization comes first. The main risk for older parents is the public charge assessment under the new rule in effect since September 18, 2026.

Who it fits

US citizens 21+ whose parents live abroad
Citizens whose parents are lawfully in the US
Families filing for both parents
Stepparents and adoptive parents, if conditions are met
Families with mismatched surnames and documents
Sponsors who need a joint sponsor

What the law requires

Below is a brief summary of the requirements as of October 2026.

Official USCIS page on Form I-130 →

USCIS updates its website periodically. If a link doesn't open, search for the category on uscis.gov.

What we prepare

  • An I-130 petition for each parent
  • Proof of relationship and explanations of surname differences
  • The I-485 with I-765 and I-131 when filing in the US
  • NVC and DS-260 documents for the consular path
  • The I-864 affidavit and the sponsor's financial documents
  • Certified translations of Soviet-era and current certificates

Timeline and stages

  1. 1first step

    Choosing the path

Your citizenship, where the parent is, and how they entered.

  2. 2depends on archives

    Proof of relationship

    Certificates, marriages, name changes, translations.

  3. 3one per parent

    Filing I-130

On its own, or with I-485 if the parent is lawfully in the US.

  4. 4median ≈ 13 months

    I-130 review

Median for immediate relatives in FY2026, per USCIS data cited by law firms.

  5. 5depends on the office

    I-485 or consulate

The interview may be waived, but that is not guaranteed.

  6. 6after approval

    Green card

On the consular path, the card is mailed after entry to the US.

Fees as of October 2026: I-130 — $675 on paper or $625 online, per parent; I-485 — $1,440; optional I-765 — $260 and I-131 — $630. Consular path: $325 visa fee, $120 I-864 review, $235 USCIS Immigrant Fee. There is no fee waiver for I-130.

Honest expectations

USCIS or the consulate makes the decision, not us. We don't promise a result. Most problems in parent cases come not from the relationship documents but from what happens while waiting: using a B-2 visa as a shortcut, traveling without advance parole, taking benefits without weighing the consequences. Questions about public charge, past violations and the choice of path are handled with partner licensed immigration attorneys.
