The E-2 visa for investors from treaty countries

The E-2 lets you live in the US and run a business you have invested your own money in. We prepare the documents for the consulate or USCIS.

What is the E-2

The E-2 is a nonimmigrant visa for an investor who puts their own funds into a real US business and runs it personally. Only citizenship of a country with a US treaty of commerce or investment qualifies — for example, Kazakhstan, Kyrgyzstan, Ukraine, Georgia, Armenia, Azerbaijan or Moldova. Russia, Uzbekistan, Tajikistan, Turkmenistan and Belarus have no such treaty (per the State Department table as of October 2026). The law sets no fixed minimum investment. The spouse and children under 21 receive derivative status.

Who the E-2 fits

Citizens of US treaty countries
Buyers of an existing business or franchise
Founders of a new US business
Entrepreneurs who run the company themselves
Key employees of an E-2 company with the same nationality
Investor families: spouse and children under 21

What the criteria require

The consulate and USCIS check several conditions at once. Below is a brief summary as of October 2026.

Official USCIS page on E-2 →

USCIS updates its website periodically. If a link doesn't open, search for the category on uscis.gov.

What we prepare

  • A structured set of investment evidence
  • Source-of-funds documents for the entire chain
  • A file documenting the company's operations
  • Forms DS-160 and DS-156E, or I-129 and I-539
  • Certified translations and notarization at our Brooklyn office
  • The complete package for the consulate or USCIS

Timeline and stages

  1. 1first step

    Nationality and business review

We check the treaty country, the 3-year rule and the ownership structure.

  2. 2before filing

    Investment and registration

The company is registered and funds are invested or held in escrow.

  3. 3depends on documents

    Gathering evidence

Source of funds, expenses, contracts, company operations.

  4. 4consulate or USCIS

    Filing

DS-160 and a consular interview, or I-129 if you are lawfully in the US.

  5. 5per consulate schedule

    Interview and decision

Since September 2025, almost all applicants have an in-person interview.

  6. 6up to 2 years per entry

    Status and extensions

Extensions of 2 years each, with no limit, as long as the business operates.

Fees as of October 2026: E visa consular fee — $315; Form I-129 in the E category — $1,015 plus the $600 Asylum Program Fee ($300 for employers with up to 25 employees); premium processing — $2,965. Check amounts before paying.

Honest expectations

The decision belongs to the consulate or USCIS, not to us. We don't promise a result — honestly, no one can. What we do: assemble the documents so the investment, the source of funds and the company's operations are proven consistently. Legal strategy — choice of country, the 3-year rule, the path to a green card — is handled by our partner licensed immigration attorneys. If we see the E-2 isn't right for you, we'll say so.
