A green card through marriage to a US citizen or resident

Your spouse files Form I-130, and you obtain status inside the US or through a consulate. We prepare the full package and check that every form is consistent.

How a marriage green card works

A marriage green card has two stages: the spouse — a US citizen or green card holder — files Form I-130, and the foreign spouse then obtains status inside the US (I-485, adjustment of status) or through a consulate (NVC and DS-260). Spouses of US citizens are immediate relatives: there is no queue, and after a lawful entry I-130 and I-485 can be filed together. Spouses of green card holders fall into the F2A category and depend on the Visa Bulletin. If the marriage is less than two years old on the approval date, a 2-year conditional green card is issued.

Who it fits

Spouses of US citizens who are in the US
Spouses of US citizens living abroad
Spouses of green card holders (F2A)
Couples where the foreign spouse entered the US lawfully
Conditional green card holders (I-751)
Couples who need a joint sponsor on the I-864

What the law requires

The path depends on the sponsoring spouse's status, not on your country. Below is a brief summary as of October 2026.

USCIS updates its website periodically. If a link doesn't open, search for the category on uscis.gov.

What we prepare

  • The I-130 petition and Form I-130A
  • The I-485 application with I-765 and I-131
  • The I-864 affidavit and the sponsor's financial documents
  • A curated set of bona fide marriage evidence
  • NVC and DS-260 documents for the consular path
  • Certified translations and notarization

Fees as of October 2026 (paper filing inside the US): I-130 — $675 ($625 online), I-485 — $1,440, I-765 — $260, I-131 — $630, $3,005 in total. Consular path: DS-260 — $325, I-864 review at NVC — $120, USCIS Immigrant Fee — $235. The medical exam and translations are paid separately.

Honest expectations

USCIS or the consulate makes the decision, not us. We don't promise a result. Since August 2026, USCIS may deny for insufficient evidence without an RFE, so the package must be complete the first time — that is exactly what we work on. If the case carries risks — overstay in F2A, past denials, arrests, removal orders — a partner licensed immigration attorney reviews it before filing.
