Key facts
USCIS fees in 2026 for most core forms remain at the level set by the 2024 rule: I-130 — $675 on paper or $625 online, I-485 — $1,440, N-400 — $760 on paper or $710 online. Starting October 16, 2026, under H.R. 1, higher fees apply for asylum, parole, TPS, and initial work permits. On November 30, 2026, EB-5 fees will rise. Below are all amounts by category, a breakdown of how much a green card costs in 2026, and the fee waiver rules.
In short:
- Core fees (I-130, I-485, I-140, I-129, N-400) have not changed since April 1, 2024, as of October 16, 2026. The current edition of the G-1055 fee schedule is dated 10/07/2026.
- From October 16, 2026: annual asylum fee — $105, initial EAD for asylum, parole, and TPS — $570, I-821 (TPS) — $520, parole fee — $1,050. H.R. 1 fees cannot be waived or reduced.
- Premium processing (I-907) went up on March 1, 2026: $2,965 for I-140 and most I-129 petitions, $2,075 for I-539, $1,780 for I-765.
- The increase in the US citizenship fee to $1,330 and $1,280 is so far only proposed and has not taken effect.
- An incorrect amount is grounds for rejection of the package. Check the amount against G-1055 before mailing.
How much a green card costs in 2026: forms for filing inside the US
Since April 1, 2024, the I-485 fee no longer includes the work permit and advance parole. They are paid separately. Biometrics are included in the base fee; the separate $85 charged before 2024 is no longer paid.
| Form | Purpose | Paper | Online |
|---|---|---|---|
| I-130 | Petition for a relative | $675 | $625 |
| I-485 | Adjustment of status to a green card (adult) | $1,440 | $1,390 (not for family-based cases) |
| I-485 | Child under 14 filing with a parent | $950 | — |
| I-765 | EAD with a pending I-485 (I-485 filed on or after April 1, 2024) | $260 | — |
| I-131 | Advance parole (travel permission) | $630 | $580 |
| I-864 | Affidavit of Support when filed with USCIS | $0 | — |
| I-751 | Removal of conditions on a conditional green card | $750 | $700 |
| I-90 | Green card replacement or renewal | $465 | $415 |
Not all forms can be filed online, and not in every situation. With concurrent filing of I-130 and I-485, the package is generally sent on paper, so use paper rates in your calculations. Since September 18, 2026, a new edition of I-485 tied to the new public charge rule is in effect. A package on the old edition may be rejected.
Example (hypothetical): a US citizen files for his wife, who is lawfully in the US. On paper, the I-130 + I-485 + I-765 + I-131 package costs $675 + $1,440 + $260 + $630 = $3,005. This does not include the medical exam (I-693) with a civil surgeon, certified translation of documents, or professional services.

How much a green card costs through a consulate: USCIS Immigrant Fee and State Department fees
If the green card is processed through NVC and a consulate, fees are paid to two agencies: USCIS (for the petition and card production) and the State Department (for processing the visa application).
| Fee | Charged by | Amount |
|---|---|---|
| I-130 (petition) | USCIS | $675 / $625 online |
| Family-based immigrant visa (DS-260) | State Department | $325 |
| Employment-based immigrant visa (I-140, I-526) | State Department | $345 |
| Other immigrant visas (including I-360-based) | State Department | $205 |
| Affidavit of Support review (I-864) | State Department (NVC) | $120 |
| Diversity Visa (lottery): application | State Department | $330 |
| USCIS Immigrant Fee (green card production) | USCIS | $235 |
The USCIS Immigrant Fee is paid online after receiving the immigrant visa and before entering the US. Until the fee is paid, the physical card will not be produced.
Example (hypothetical): a US citizen files for a parent living abroad. Government fees: $675 (I-130) + $325 (DS-260) + $120 (I-864) + $235 (USCIS Immigrant Fee) = $1,355. The medical exam with a panel physician and translations are paid separately.
The filing process for parents is covered in our article green card for parents.

Employment-based fees: I-129, I-140, and the Asylum Program Fee
An Asylum Program Fee is added to I-129 and I-140 petitions. The amount depends on who files the petition: $600 — standard, $300 — for employers with 25 or fewer full-time employees, $0 — for nonprofits. I-140 self-petitioners (EB-1A, EB-2 NIW) with 25 or fewer U.S. employees — including none — pay $300, as the USCIS Form I-140 instructions expressly provide.
| Form / category | Standard (paper) | Online | Small employer / nonprofit |
|---|---|---|---|
| I-129 H-1B | $780 | $730 | $460 |
| I-129 L-1 | $1,385 | $1,335 | $695 |
| I-129 O-1 | $1,055 | $1,005 | $530 |
| I-129 E-1, E-2, E-3, TN (change or extension of status in the US) | $1,015 | $965 | $510 |
| I-140 (EB-1, EB-2, EB-3) | $715 | $665 | $715 |
| Asylum Program Fee (I-129, I-140) | $600 (more than 25 employees) | — | $300 (25 or fewer employees, self-petitioners) / $0 (nonprofits) |
| I-539 (extension or change of nonimmigrant status) | $470 | $420 | — |
Reduced rates for small employers and nonprofits apply only to I-129. They affect I-140 only through the Asylum Program Fee.
The $100,000 H-1B fee
On September 30, 2026, the federal court for the Northern District of California (Global Nurse Force v. Trump) barred enforcement of the USCIS and CBP guidance on collecting the $100,000 H-1B fee (including under the proclamation extending it) until a rulemaking with public notice and comment is carried out. The fee did not apply to a change of status inside the US, for example from F-1 to H-1B, even before. On October 9, 2026, the government appealed to the Ninth Circuit; as of publication (October 16, 2026), the outcome is unknown. Details are in our article the $100k H-1B fee.
Example (hypothetical): a researcher files an I-140 under EB-1A as a self-petitioner with premium processing. Total: $715 + $300 (Asylum Program Fee) + $2,965 (I-907) = $3,980. Fees for I-485 and related forms are paid separately.
Premium processing (I-907) in 2026
New amounts have been in effect since March 1, 2026 (Federal Register, January 12, 2026, document 2026-00321). The increase reflects inflation (CPI-U) of 5.72% from June 2023 to June 2025. Packages postmarked on or after March 1, 2026, without the new amount are rejected.
| What is expedited | Before March 1, 2026 | From March 1, 2026 |
|---|---|---|
| I-129: E, H-1B, H-3, L, O, P, Q | $2,805 | $2,965 |
| I-129: H-2B, R-1 | $1,685 | $1,780 |
| I-140: EB-1, EB-2, EB-3 (including NIW) | $2,805 | $2,965 |
| I-539: change of status to F, J, M; E, H, L, O, P, R dependents | $1,965 | $2,075 |
| I-765 (for example, OPT and STEM OPT) | $1,685 | $1,780 |
Premium processing only speeds up the decision: approval, RFE, or denial. It does not improve the chances of approval. For EB-2 NIW, USCIS allows 45 business days for a decision, not 15.
H.R. 1 fees from October 16, 2026: asylum, parole, TPS, EAD
H.R. 1, signed on July 4, 2025, introduced mandatory fees. They are adjusted annually for inflation. The fiscal year 2027 adjustment was published in the Federal Register on October 1, 2026 (document 2026-20187) and applies to packages postmarked on or after October 16, 2026. For online filings, the filing date controls. The adjustment is based on CPI-U from July 2025 to July 2026 (about 3.36%); amounts are rounded down, so some fees did not change.
| Fee | FY 2026 (from January 1, 2026) | FY 2027 (from October 16, 2026) |
|---|---|---|
| I-589: asylum application filing | $100 | $100 |
| Annual asylum fee (while I-589 is pending for a year or longer) | $102 | $105 |
| I-765: initial EAD — asylum, parole, TPS | $560 | $570 |
| I-765: asylum EAD renewal | $275 | $275 |
| I-765: parole and TPS EAD renewal | $280 | $280 |
| I-821 (TPS) | $510 | $520 |
| Parole fee (I-131) | $1,020 | $1,050 |
| I-360 (SIJ) | $250 | $250 |
| I-94 fee | $24 | $24 |
H.R. 1 fees are paid on top of the form's base fee, if one is set. Under the interim final rule of April 29, 2026 (effective May 29, 2026), these fees cannot be waived or reduced. The annual asylum fee is paid online after a USCIS notice. If it is not paid within 30 days, the I-589 is rejected and the asylum-based work permit terminates.
Important: according to legal reviews of G-1055, applicants with a pending I-485 returning on advance parole are exempt from the parole fee, and for them I-131 costs $630. The fee is tied to the date parole is granted, not the filing date. Before traveling, check the current I-131 instructions.

US citizenship fee: N-400, N-600, and the proposed increase
| Form | Paper | Online | Note |
|---|---|---|---|
| N-400 (naturalization) | $760 | $710 | Reduced fee of $380 — paper only, for income up to 400% of the federal poverty guidelines |
| N-400 for military members (on the relevant grounds) | $0 | $0 | — |
| N-336 (appeal of an N-400 denial) | $830 | $780 | — |
| N-600 (certificate of citizenship) | $1,385 | $1,335 | — |
On June 23, 2026, DHS published a proposed rule (Federal Register 2026-12542). It proposes raising N-400 to $1,330 on paper and $1,280 online, and N-336 to $1,475 and $1,425. The proposal also eliminates the reduced fee and fee waivers for these forms. The comment period closed on August 24, 2026. As of October 16, 2026, no final rule has been published, and the current amounts apply. The new amounts will take effect only once a final rule with an effective date is published.
If you are ready to file N-400, there is no point in waiting: the current fee still applies. Requirements and steps are described in our article US citizenship in 2026.
EB-5 fees: what changes on November 30, 2026
The EB-5 fees introduced on April 1, 2024, were suspended by the ruling in Moody v. Noem of November 12, 2025. USCIS currently charges the prior amounts. On September 30, 2026, the final rule on EB-5 fees (91 FR 61940) was published; it takes effect on November 30, 2026.
| Form | Current | From November 30, 2026 |
|---|---|---|
| I-526 (standalone investor) | $3,675 | $7,615 |
| I-526E (regional center investor) | $3,675 | $7,850 |
| EB-5 Integrity Fund (when filing I-526E) | $1,000 | $1,100 |
| I-829 (removal of conditions) | $3,750 | $5,000 |
| I-527 (amendment of a previously filed I-526, new form) | — | $10,330 |
| I-956 / I-956F (regional center, project) | $17,795 | $44,115 / $42,675 |
The postmark date is decisive. A package sent before November 30, 2026, is paid at the old amounts. No additional fee is charged on an already-filed I-526E. More in our article EB-5 and the Gold Card.
Nonimmigrant visa fees and the visa integrity fee
State Department visa application (MRV) fees have not changed:
| Visa category | Fee |
|---|---|
| B-1/B-2, F, J, M, TN, and other non-petition visas (DS-160) | $185 |
| H, L, O, P, Q, R (petition-based) | $205 |
| E (treaty investors and traders) | $315 |
| K (fiancé(e) of a US citizen) | $265 |
Under H.R. 1, a visa integrity fee of $250 per issued nonimmigrant visa is added to these. It is paid at visa issuance, not at application. Immigrant visas and ESTA are not subject to this fee. According to university reports, some consulates already collect it. As of publication (October 16, 2026), there is no official State Department confirmation of universal collection, and no refund procedure has been approved. Visa bonds of $10,000–$20,000 apply to certain countries. More on them in our article countries under US restrictions in 2026.
Can you avoid paying the fee: I-912 and reduced fees
A fee waiver is requested on Form I-912, usually on paper only. Grounds: receipt of means-tested benefits, income at or below 150% of the federal poverty guidelines, or serious financial hardship. A waiver is available only for a limited list of forms, mainly N-400, N-600, I-90, I-751, I-765 in certain categories, and humanitarian applications.
Where no waiver is available:
- H.R. 1 fees (asylum, parole, TPS, EADs for these categories, I-94) cannot be waived or reduced under any circumstances;
- I-130, I-140, I-129, I-485 (on employment-based and most family-based grounds) are paid in full;
- N-400 and N-336 — if the 2026 proposed rule is adopted as proposed, the waiver and reduced fee will be eliminated.
If you file I-912 without the required evidence, you risk having the entire package rejected. Deadlines may be lost as a result.
What to do now
- Download the current G-1055 (the edition dated 10/07/2026 is now in effect) and find every form in your package in it. Calculator websites and other people's calculations may be outdated.
- Use the official USCIS Fee Calculator. It accounts for category, age, and filing method.
- Check H.R. 1 fees, the Asylum Program Fee, and I-907 as separate line items. They are often forgotten.
- If you are mailing a package around October 16 or November 30, 2026, go by the postmark date and keep proof of mailing.
- Check the payment method. Card payments require Form G-1450; bank account debits (ACH) require G-1650. Confirm whether USCIS accepts checks for your form.
- Pay separately for each form. If one payment fails, the entire package may be rejected.
- Use only the current edition of the form. For I-485, that is the edition mandatory since September 18, 2026.
- If a package is rejected because of the fee, correct the amount and refile. The priority date and filing dates are not preserved on rejection.
Important: USCIS does not review a package with an incorrect amount — it returns it (rejection). If your timeline is tight (status extension, the 240-day rule, approaching age 21 under CSPA), discuss the situation with an immigration attorney before filing.
