A fine-art photographer was approved for an O-1B visa, the category for people with extraordinary ability in the arts. The petition was filed by a U.S. agent we helped find. It took 20 days from filing to approval, and the status was approved for three years.

Who our client is

Our client creates staged black-and-white photography. He does not composite his images: he builds every frame live. He imagines a scene, constructs it, lights it and shoots it the way a film director would.

His path into art is unusual. He worked as an engineer for about thirteen years, began shooting for commercial clients on the side, and in 2022 moved to photography full-time. He is self-taught. Today he has solo exhibitions, international awards, features in foreign publications and his own photography school.

Why O-1B

O-1B is a U.S. work visa for people in the arts: photographers, artists, musicians, actors. You need to show that you are recognized in your field and meet at least three of the six USCIS criteria.

In this case we built the argument for five of the six criteria: exhibitions and projects where the client was the lead author, published material about his work, recognition from the professional community, and his level of earnings.

What an agent-petitioner is

You cannot self-petition for O-1B: Form I-129 is filed by a U.S. petitioner. That can be an employer or an agent, a U.S. company that represents the professional and coordinates his projects in the U.S.

The client had no U.S. company that could file a petition for him. We helped him find an agent. The client keeps full creative control over his work.

What the M&M team did

  1. Found a petitioner. We helped the client find a U.S. agent willing to file the petition.
  2. Collected the evidence. Exhibitions, awards, publications, client contracts and recommendation letters, all translated and organized by criterion.
  3. Obtained a peer-group opinion. O-1B requires a written advisory opinion from a relevant organization. It was issued by a U.S. association of professional photographers.
  4. Worked with a partner attorney. The legal side of the case was handled by a licensed attorney.

How long the review took

  • October 1, 2026: USCIS received the I-129 petition.
  • October 21, 2026: the O-1B petition was approved.

Result: I-129 approved

USCIS approved the O-1B petition. The status is valid from October 21, 2026 through September 30, 2029. The client will receive his visa at a U.S. consulate.

Why it worked

  1. The petitioner question was solved. Having no U.S. company was not an obstacle: an agent took on that role.
  2. Stronger than the minimum. Five of six criteria where three are required.
  3. A turnkey package. Evidence, translations and the professional organization's opinion within one team, with the legal side handled by a partner attorney.
